Travel conditions

1. Conclusion of contract

Der Vertrag kommt mit dem Zugang der Buchungsbestätigung zustande, die keiner Form bedarf, mit der Folge, dass mündliche und telefonische Bestätigungen für den Gast und Frau Marina Cipic Grübener (im folgenden „Vermieter“ genannt) rechtsverbindlich sind.

2. Prices / services

The rental prices stated on the homepage are final prices and include VAT. 

3. Payment

The due date of down payments and final payments is based on the regulation noted in the booking confirmation.
A deposit of 10% of the rental price must be paid. The remaining payment must be made 30 days before the start of the trip without being requested to do so again. If the down payment is not received on time and no payment is made even after being requested to do so, the lessor is entitled to withdraw from the contract. In this case, the cancellation fees stated under 4. will be charged. In the case of very short-term bookings, the landlord reserves the right to request the full travel price immediately.

4. Cancellation and no-show

In the event of withdrawal, the landlord's claim to payment of the agreed accommodation price, including the fees for any additional services, remains.

According to the percentages recognized by the case law, the following payments are to be made when the guest withdraws:

On the day of departure, in the event of no show and cancellation after the start of the trip, 100% of the travel price.

The guest's cancellation must be in writing, the day of receipt by the landlord is decisive. Replacement tenants must be approved by the landlord. If a replacement tenant can be provided by the landlord, only an expense allowance of 10% of the travel price is due.
Taking out travel cancellation insurance is highly recommended.

5. Cancellation by the landlord

The lessor can withdraw from the contract before the start of the trip or terminate the travel contract without observing a deadline after the start of the trip if the guest permanently disrupts the trip despite warning and endangers others through his behavior or otherwise behaves contrary to the contract. In this case, the travel price is forfeited.

6. Insurance / damage

The private liability insurance or animal liability insurance usually also regulate damage in holiday homes caused by you as a customer.
We recommend that you check whether your insurance covers such damage.
Damages must be reported immediately.
If the trip after the conclusion of the contract due to force majeure, which also includes destruction of the accommodation or equivalent events, is unforeseeably significantly impeded, endangered or impaired, both contract parties can terminate the travel contract.

7. Arrival and departure

The guest must arrive at the agreed time. In the event of delays, the guest should inform the landlord by phone.
The guest must leave by 11:00 a.m. at the latest. The house must be left swept clean. 

8. General

The landlord has to ensure that the house is in perfect condition. Complaints by the guest should be made immediately. If possible, the landlord will remedy the situation. If the guest fails to report a defect, there is no entitlement to a reduction.

The guest is responsible for his own safety during the stay. 
The lessor accepts no liability for accidents that occur due to the weather.
The guest undertakes to treat the rented house and inventory with care.
Pets must be registered in good time before arrival.

9. Place of jurisdiction and choice of law

Only German law applies to the contractual relationship between the customer and the lessor. This also applies to the entire legal relationship.

10. Other provisions and agreements

The data made available to us will be processed and stored within the scope of the purpose of the contract. The data will not be shared with third parties.
